1. Scope of Application
These General Terms and Conditions of Sale govern the offer and sale of products through the official VALMERIA website, in accordance with the applicable Italian and European laws and regulations on e-commerce and consumer protection.
Purchases are reserved for users of legal age acting as consumers.
By placing an order, the customer fully accepts the terms and conditions set out below.
The Seller reserves the right to amend these terms and conditions; the version in force at the time the order is placed shall apply.
2. Products
The products sold through the Website are wristwatches and accessories bearing the VALMERIA™ brand.
VALMERIA watches are designed, developed and assembled in Italy in limited series.
Given the artisanal nature of certain assembly and finishing operations, slight aesthetic or dimensional variations may occur and are to be considered a distinctive characteristic of the product rather than a defect, provided that they do not affect the product’s conformity with the sales contract.

4. Orders and Conclusion of the Contract
Submitting an order entails an obligation to pay and constitutes full acceptance of these Terms and Conditions.
Before submitting the order, the consumer may review and correct any errors in the information entered.
The order confirmation is sent by e-mail and contains the order details and information relating to the purchase.
The sales contract is deemed to have been concluded upon confirmation of the order by the Seller.
In the event that a product is unavailable, the customer will be informed and any amount already paid will be refunded.
5. Prices and payments
Prices are stated in Euros and include any applicable charges and taxes in accordance with the applicable laws and regulations.
The available payment methods are indicated during the checkout process.
Payment must be made using the methods indicated on the Website or communicated by the Seller.
The Seller shall not be liable for any fraudulent use of payment methods by third parties, except as otherwise provided by applicable law.
6. Shipping and Delivery
Orders are shipped via selected courier services.
The delivery times indicated on the Website are estimates. The Seller will arrange for delivery within the timeframe indicated at the time of purchase and, in any event, within the time limits provided for by applicable law.
Any delays caused by force majeure or by unforeseeable circumstances beyond the Seller’s control shall not give rise to any liability on the part of the Seller, without prejudice to the provisions of applicable law.
The consumer is advised to check the condition of the package upon delivery and to promptly report any irregularities.
7. Right of Withdrawal
The consumer has the right to withdraw from the distance sales contract within 14 days of receiving the product, without having to provide any reason, except in cases where the right of withdrawal is excluded by law.
The right of withdrawal must be exercised by sending an explicit notice to the Seller within the period prescribed by law. The Seller will provide the necessary instructions for returning the product.
The product must be returned within the time limits provided by law, intact and complete with its original packaging and accessories, without any handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
The consumer shall be liable for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
The direct costs of returning the product shall be borne by the customer.
The refund will be issued in accordance with the procedures and within the time limits provided by applicable law.
8. Legal Guarantee of Conformity
VALMERIA watches are covered by the legal guarantee of conformity provided for by applicable law, for a period of two years from the date of delivery of the product.
The Seller shall be liable for any lack of conformity existing at the time of delivery and which becomes apparent within the time limits provided by law.
In the event of a lack of conformity, the consumer shall be entitled to the remedies provided by law, including, where applicable, repair or replacement of the product at no cost to the consumer and, in the cases provided for by law, a price reduction or termination of the contract.
The legal guarantee does not cover damage or defects arising from causes occurring after delivery that are not attributable to a lack of conformity.
The rights granted to the consumer under the legal guarantee are not limited by these Terms and Conditions.

9. VALMERIA commercial warranty
Where provided for the specific model, the VALMERIA commercial warranty is an additional conventional warranty to the legal guarantee of conformity and is governed by the terms set out in the relevant Warranty Card and the user and instruction manual provided with the product.
The commercial warranty does not limit or replace the rights granted to the consumer under the legal guarantee of conformity.
10. Liability
The Seller shall not be liable for indirect or consequential damages to the extent permitted by law, nor for delays or failures to perform caused by unforeseeable, unavoidable events or events otherwise beyond the Seller’s reasonable control.
The liability imposed by applicable mandatory provisions shall in all cases remain unaffected, including those relating to product safety and consumer protection.
11. Intellectual property
The VALMERIA™ trademark, logos, texts, images, drawings, designs, graphic content and other elements featured on the Website are protected under applicable intellectual and industrial property laws.
The reproduction, distribution, modification or use of the content of the Website without the prior authorisation of the relevant rights holder is prohibited.
